Our attorneys clawed back hundreds of thousands of dollars for the legal spouse of a deceased individual whose estate was “looted” by an adult child many years before the client hired us. The adult child surreptitiously gained control of the estate by making misrepresentations to the court, and then managed to sell the decedent’s real estate, all before our client realized what happened.
The hotly contested issue of the litigation was whether our client qualified as a surviving spouse of the deceased. The parties were married decades prior and allegedly separated without obtaining a legal separation or divorce. Even though testimony evidence tended to establish that the parties had been living separate lives, in separate states, for decades, we overcame adverse conditions to establish a significant entitlement for our client.
